Pre-test into Legal Issues on the School Sports Injury Accidents

Abstract

This article discusses some views about the problem of the school sports injuries, clarifies some reasons of the monitoring relationship between students and school, monitoring transfer relationship, and principal-agent relationship, respectively based on the education law and the protection of minors, involving in the principle of liability fixation use of the civil compensation, to get “the basis on fault liability, the supplement for fair liability”. Improve legislation or strengthen judicial interpretation and strictly transform fault liability to gradually realize the risk socialization.
