In Art. II lit. a) – e) Genozidkonvention sind die möglichen Tathandlungen zur Begehung eines Genozids abschließend aufgeführt. Während der Vorarbeiten wurde vorgeschlagen, die Verletzungshandlungen beispielhaft zu formulieren. Die entsprechenden Vorschläge setzten sich unter anderem deshalb nicht durch, weil eine einheitliche Anwendung der Konvention in den Mitgliedstaaten sichergestellt werden sollte.1

Die zitierten Vorschriften sowie das Proportionalitätsprinzip wurden im Bericht des Anklägers des ICTY im Hinblick auf das NATO-Bombardement im ehemaligen Jugoslawien überprüft. Der Bericht kommt zu dem Ergebnis, dass seitens der NATO kein Verstoß gegen die genannten Regelungen vorlag und deshalb kein Verfahren gegen die für das Bombardement verantwortlichen Personen eingeleitet werden sollte.
