Zusammenfassung
Transparenz ist eines dieser gesellschaftlichen Phänomene, das wünschenswert erscheint und dann auch wieder nicht. Anscheinend widersprüchliche Beobachtungen zur Transparenz verdeutlichen das unmittelbar: Eine Gesellschaft, in der es keine Geheimnisse gibt, ist unrealistisch. Geheimnisse „als bewußt gewolltes Verbergen“ (Simmel [1908] 1992: 392) sind ein unverzichtbarer Teil gesellschaftlichen Zusammenlebens (Bok [1983] 1989). Andererseits erfordert es, insbesondere in der Gegenwart, enorme Ressourcen, um Informationen und Erkenntnisse geheim zu halten (siehe Gallison 2004). Paradoxerweise sind es gerade umfassende Geheimhaltevorschriften, die in demokratischen Gesellschaften als Angriff auf die Demokratie und in autokratischen Gesellschaften als Motor der Demokratisierung verstanden werden, und somit insgesamt den Anreiz erhöhen, Geheimnisse öffentlich zu machen. Wir wissen außerdem, wie Heinrich Popitz (1968: 18) für die Institution des Rechts gezeigt hat, dass eine „totale Verhaltenstransparenz menschlicher Gesellschaften“ ebenso unmöglich ist wie ein „Normensystem, das die Entdeckung aller Normbrüche aushalten würde“.
