Vom Völkerrecht zur Welt-Literatur. Zum juristischen Kontext der modernen Dichtung

Zusammenfassung

Es gibt heutzutage verschiedene Rahmen für das Studium der Weltliteratur, die über die normalen Mittel der Kritik hinausgehen und eine vergleichende Perspektive beinhalten. Man denke vor allem an den Begriff „Netzwerk“ oder an das Phänomen der „Globalisierung“. Ich möchte jedoch ganz allgemein den Standpunkt der „vergleichenden Studien“ (comparative studies) vertreten, dabei aber erstmals, wie ich meine, den Vergleich mit dem Recht behandeln, zumal dem Völkerrecht. Es werden die Arbeiten von Grotius, Pufendorf und de Vattel auf diese Frage hin behandelt. Die These von der Bedeutung des Rechts wird sodann an Beispielen aus der modernen Literatur untersucht. Besprochen werden Werke von Goethe, Tolstoi, Hasek, Musil und Joyce. Im großen Roman der Moderne angefangen von 'Wilhelm Meisters Wanderjahre' wird versucht, eine Enzyklopädie der Welt zu entwerfen. Stets finden sich dabei Hinweise auf das Völkerrecht.
