Zusammenfassung

Im Besonderen Teil des Schuldrechts enthält das BGB sog. typische Vertragsarten. Die praktisch wichtigsten und häufigsten Vertragsarten werden hier geregelt: z.B. Kauf-, Tausch-, Miet-, Leih-, Werk-, Darlehensvertrag usw.. Schließen die Vertragsparteien einen typischen Vertrag und vereinbaren nichts näheres oder abweichendes, gelten automatisch die gesetzlichen Bestimmungen zu diesem Vertragstyp.
