Zusammenfassung

Als Eamon de Valera, der Präsident des irischen Executive Council, im Jahre 1935 John J. Hearne, den Rechtsberater des Außenministeriums den Auftrag erteilte, die Grundlagen für eine neue Verfassung auszuarbeiten, konnte dieser bereits auf zwei Modelle zurückgreifen, die die Verfassungsgeschichte des erst seit zwölf Jahren unabhängigen Staates geprägt hatten: Als erste irische Verfassung gilt jener Text, der von dem selbsternannten Parlament (Dáil Éireann) im Jahre 1919, also noch zur Zeit des Unabhängigkeitskampfes, erarbeitet worden war. Nach der Unterzeichnung des anglo-irischen Vertrages vom Dezember 1921, der die Schaffung des Saorstat Éireann (Irish Free State) vorsah, gab sich dessen nunmehr international anerkanntes Parlament im Jahre 1922 eine zweite Verfassung, die sich am britischen Vorbild orientierte und eine Zweikammer-Legislative aus Abgeordnetenhaus (Dáil Éireann) und Senat (Seanad Éireann) schuf, dessen Exekutive (Executive Council) dem Abgeordnetenhaus gegenüber verantwortlich war.
