Zusammenfassung
Bislang sind alle Versuche fehlgeschlagen, ein System prozeduraler Regeln der kollektiven Arbeitsbeziehungen auf der Ebene der Europäischen Union zu schaffen (vgl. Keller 1993; Silvia 1992).1 Es gibt keine gemeinsamen europäischen Normen in bezug auf Tarifverhandlungen und Tarifverträge, Rechte und Pflichten von Gewerkschaften, kein europäisches Streik- und Aussperrungsrecht und keine europäischen Regelungen der Arbeitnehmermitbestimmung auf der betrieblichen Ebene.2 Diese Verfahrensregeln („prozedurale Regeln“) auf deren Grundlage materielle Fragen gelöst werden, bilden freilich den Grundstock eines Systems der kollektiven Arbeitsbeziehungen mit formal staatlich unabhängigen Interessenverbänden — so wie es von nationalstaatlichen Systemen her bekannt ist.
