Zusammenfassung

Architekt wie Ingenieur erbringen einen geistigen Beitrag zur Erstellung des Bauwerks, sie schulden das Bauwerk selbst nicht als körperliche Sache (1). Obwohl beide — Architekt und Ingenieur — als vertraglich geschuldete Leistung das „Entstehenlassen“ des mängelfreien Bauwerks schulden, sind ihre Leistungen doch so unterschiedlich, daß eine Gesamtschuld im Sinne des § 421 BGB nicht anzunehmen ist.
