Zusammenfassung

In einem Werkvertrag über Planungsleistungen oder durch gesonderte Vereinbarung können die Vertragsparteien eine Vertragsstrafe als zusätzliche Leistungsverpflichtung bestimmen, falls ein Teil seine vertraglichen Pflichten gar nicht oder nur unvollkommen erbringt. Dabei hat die Vertragsstrafe den Zweck, den Schuldner von Vertragsverletzungen abzuhalten und dem Gläubiger ein rechtmäßiges Druckmittel an die Hand zu geben, um die Erfüllung der Vertragspflichten durch den anderen Teil zu erreichen (1).
