Zusammenfassung
Institutionelle Regelungen beeinflussen menschliches Handeln. Sie grenzen Entscheidungsspielräume ein und setzen Verhaltensanreize. Trotz Freiheit von Forschung und Lehre bewegt sich auch das Geschehen in der Wissenschaft nicht im institutionellen Freiraum. Wie das folgende Beispiel zeigt, wirken institutionelle Regelungen sogar auf die Wahl (m)eines Habilitationsthemas ein: Habilitationsschriften unterliegen nicht der Pflicht zur Publikation1) — eine institutionelle Regelung, in der sich die Habilitationsordnung grundlegend von der Promotionsordnung unterscheidet. Böse Zungen behaupten, hierin liege die Ursache dafür, daß die Qualität vieler Habilitationsschriften hinter derjenigen der Dissertation des betreffenden Autors zurückbleibe. Ob solche Qualitätsunterschiede tatsächlich existieren und — wenn ja — ob sie auf die Anreizwirkung der fehlenden Veröffentlichungspflicht zurückzuführen sind, wird sich kaum zweifelsfrei klären lassen. Die Probleme, die mit der Messung der Qualität von Wissenschaft verbunden sind2) sowie bei dem Versuch der empirischen Überprüfung von Hypothesen über die Wirkung institutioneller Regelungen auftreten3), sind zu vielfältig, als daß hier eindeutige Ergebnisse zu erwarten wären. Doch unabhängig davon, welche Relevanz man dem Argument von möglichen Fehlanreizen in der Habilitationsordnung beimißt, die fehlende Pflicht zur Veröffentlichung eröffnet dem Habilitanden zweifelsohne Freiheitsgrade. Diese müssen jedoch nicht ausschließlich im Sinne einer — nutzenmaximierenden(?) — Reduzierung des‘Arbeitsleides’4) genutzt werden, sondern können auch weniger negativ anmutende Auswirkungen zeigen.
