Zusammenfassung
Der Property Rights-Ansatz ist eine — inzwischen schon recht alte — Konzeption, mit der die Entstehung, Ausgestaltung und Zuordnung von Rechten, etwas zu tun, zu fordern, zu unterlassen und zu verhindern, beurteilt und erklärt werden können1. Er weist offensichtlich in inhaltlicher und methodischer Hinsicht eine beträchtliche Nähe zur Finanzierungstheorie auf. Die inhaltliche Nähe ergibt sich daraus, daß durch Finanzierungsvorgänge Verfügungsrechte geschaffen und/oder übertragen werden, daß sie auf (Finanz-)Märkten gehandelt werden und daß finanzwirtschaftliche Institutionen — vom Kreditvertrag bis zur Universalbank — als spezifische Konfigurationen von Verfügungsrechten angesehen werden können. Die methodische Nähe ergibt sich daraus, daß das Argumentieren mit individualistischen Bewertungsmaßstäben, mit der Berücksichtigung institutioneller Daten bei Entscheidungen und mit Markt-Gleichgewichtsbedingungen in der Finanzierungstheorie seit jeher üblich ist. Wegen dieser doppelten Nähe ist es vergleichsweise einfach, bekannte Sachverhalte mit neuen Begriffen zu belegen und bekannte Fragen und Antworten modisch aufpoliert zu reformulieren. Daraus ergeben sich auch einige interessante Parallelen und Wechselwirkungen zwischen der neoklassischen Finanzierungstheorie, die die Zuordnung (Allokation) von einfachen Property Rights zum Gegenstand hat, und dem ursprünglichen Property Rights-Ansatz. Dies wird im Abschnitt B gezeigt.
