Zusammenfassung

Die Kernthese der vorliegenden Arbeit ist, daß die voranschreitende Verdichtung des Staats-Wirtschafts-Komplexes eine Technokratisierung des Rechts und der Justizverwaltung verursacht und damit die justiziellen Entscheidungsformen wesentlich funktionalisiert und instrumentalisiert. Dieser historisch verstandene Prozess hat verschiedene Aspekte. Technokratisierung des Rechts bedeutet zunächst, daß die materiale Rationalität des spät-kapitalistischen Staats-Wirtschafts-Komplexes die mit der bürgerlichen Gesellschaft eng verbundene formale Rationalität des Rechts aufzuheben beginnt. Darüberhinaus aber bedeutet dieser Prozess das Überschreiten des formalen und materialen Rechtsbegriffs und deren Aufhebung in einem neuen, nämlich system-theoretischen und technokratischen Rechtsbegriff. Dabei wird nicht angenommen, daß diese analytisch unterschiedenen Rechtsbegriffe notwendig bestimmten historischen Epochen entsprechen; nur, daß der formale Rechtsbegriff aus historischen und politischen Gründen mit der neuen Staats-Wirtschafts-Räson in einen Widerspruch gerät. Dieser neue technokratische Rechtsbegriff ist in einem anderen Zusammenhang auch „responsive law“ oder „responsives-zweckhaftes“ Recht genannt worden, wobei „zweckhaft-responsives Recht“ (ein inhaltlich bestimmter materialer Rechtsbegriff) dem „autonomous law“ (unabhängiges, formales Recht) gegenübergestellt wird (Nonet und Selznick, 1978).
