Zusammenfassung
Eine Tagung in Osnabrück ist eine willkommene Gelegenheit, den bekanntesten Politologen dieser Stadt zu Wort kommen zu lassen: das ist — gegenwärtige Fachvertreter mögen mir das verzeihen — immer noch Justus Möser. Seine Stärke war eine interpretativ-normative Policy-Lehre, die sich hauptsächlich statt im Beraten im Abraten profilierte. Der ständisch-konservative Möser fand hinreichend Staatsaktivitäten und Regierungsprogramme, deren weitere Verfolgung er für destabilisierende Störung alter Harmonien anprangerte. Eine der Modernisierungen, vor denen er warnte, fasste er als Stück 59 seiner “Patriotischen Phantasien” in die “Beantwortung der Frage: Ist es billig, dass Gelehrte die Criminalurtheile sprechen?”. Die Antwort auf die selbstgestellte Frage lautet “Nein”. Er hat sich damit bekanntlich nicht durchgesetzt, die Rechtsgelehrsamkeit als die Gewährleistung einer gleichmäßig angewandten, prozedural gesicherten und durch Gesetzesbindung kalkulierbaren Strafjustiz gilt als eine der Errungenschaften des auf Möser folgenden Jahrhunderts. Die Ironie der Geschichte aber will es, dass rückschauend aus “postmoderner” Sicht manche Fortschrittsskepsis laut wird, die Ähnlichkeiten mit den konservativen Warnungen vor dem Einsetzen der Modernisierung hat.
