Zusammenfassung

Der Senat Kanadas steht bereits seit Ende des 19. Jahrhunderts unter fortwährendem institutionellen Reformdruck. Erstens wirken in ihm aufgrund des im Jahr 1867 zur Föderationsgründung notwendigen Verfassungskompromisses zwei zueinander inkompatible Leitideen: die eines ‚schwachen’ Westminster-Bikameralismus und die eines ‚starken’ föderativen Bikameralismus.1 Zweitens bricht sich der Bestellungsmodus der Senatoren (Ernennung durch den nationalen Premierminister, in der Praxis fast immer verbunden mit parteipolitischer Patronage) spätestens seit dem frühen 20. Jahrhundert am demokratischen Legitimationsimperativ.2 Das strukturelle Dilemma besteht darin, dass dem Senat einesteils aufgrund seines — einer nur ‚schwachen’, lediglich beratenden Zweiten Kammer3 nicht notwendigerweise unangemessenen — undemokratischen Bestellungsmodus die nötige Legitimität fehlt, seine formal-konstitutionell sehr wohl gegebene Kompetenz zur Blockade von Gesetzentwürfen4 der Regierung und des Unterhauses auch praktisch auszuüben, dass er andernteils jedoch beim Verzicht auf jegliche Veto-Positionen die Möglichkeit effektiver föderativer Interessenwahrnehmung aufgibt (für die es eben einer auch praktisch handlungsfähigen Zweiten Kammer bedarf) und sich zudem leicht dem Vor-wurf institutioneller Überflüssigkeit aussetzt.5 Obendrein wird die Funktion föderativer Interessenrepräsentation in Kanada substituierend von konkurrierenden Institutionen wahrgenommen.
