Zusammenfassung

Verkehrsdelinquenz ist Massendelinquenz, in der wie nirgendwo sonst die ‚Abweichung der Braven’ sichtbar wird. Gleichzeitig führeri selbst unfallverursachende Normverstöße trotz ihrer immensen sozialen Kosten zu vergleichsweise milden staatlichen Sanktionen. Beides, täterschaftliche Ubiquität und strafrechtliche Toleranz, hängt zusammen mit einem ausschließlich instrumentell begründeten Verkehrsrecht, das ohne eine historisch gewachsene Vernetzung mit moralischen Standards bleibt. Verkehrsverstöße sind „folk crimes“ (vgl. Ross 1960). Nur schwere Übertretungen treffen auf harsche strafrechtliche Reaktionen und eine strikte Ablehnung durch die Verkehrsteilnehmer. Zu diesem Teil der Verkehrsdelinquenz gehören manche jener Integritätsverletzungen, die als aggressiv erlebt werden.
