Abstract

The chapter deals with the development of the EU regulation concerning confiscation. It examines Framework Decision 2005/212/JHA and Directive 2014/42/EU as the latter concerns only a specific list of serious crimes and the former is applied out of this area. A brief reference is also made to the proposal of regulation of 2016, which should simplify the current legal framework of the freezing orders and of the confiscation of proceeds of crime in EU countries.
