Higher Education as a Symbol of Equal Rights in South Korea

Abstract

The Korean Constitutional Law (KCL) provides “All citizens shall have an equal right to receive an education corresponding to their abilities (Art. 31. I)” and [International Covenant on Economic, Social and Cultural Rights] which was ratified in 1990 by Korean National Assembly prescribes in Article 13 (c) “Higher education shall be made equally accessible to all, on the basis of capacity, by every appropriate means, and in particular by the progressive introduction of free education.” As a state party of the Covenant, the South Korea has the duty implementing it. On the ground of this idea, in this paper, it is examined whether every Korean enjoy the right to receive higher education as a part of universal human right in substance.
