Abstract
This chapter begins with a look at the rise of the AAUP and the three areas it established as the foundation of tenure: teaching/providing quality instruction; service to the university and community as a whole; and scholarly research/publications. The discussion then shifts to an examination of five court cases that are pertinent to the discussion and their impact. Following this discussion, the all-important question of how the courts have interpreted tenure is addressed citing related court cases. A Summation and Recommendation section concludes the chapter.
