Abstract

Twenty-five years after signing the CRC, the principles and philosophy of the Convention have gradually filtered through into the Spanish legislation and have also transformed the procedures inherited from previous models. The Juvenile Criminal Act of 2000 (JCA) utilizes a model which aims to educate through punishment and punish through education. To this end, the JCA establishes a normalizing policy to give the juvenile a second chance through various strategies (descriminalization, mediation, or low-impact educational measures). In addition, a robust criminal policy to deal with persistent offenders has been established. Nevertheless, this policy, focused on custody, is applied as the last resort; in fact, the measures most commonly adopted are probation and community service.

Finally, we review the treatment received by juveniles. In this sense, we can observe a great difference between regions; thus, there are no standard protocols or common guidelines. Nevertheless, protocols and programs applied are coherent with current knowledge on antisocial behavior and risk/protection factors.

We conclude that the overall balance is positive. The development of public policies regarding childhood and social welfare, which began several decades ago, may well now be yielding results. Indeed, the juvenile crime rates have fallen, probably because something must be doing well in the Spanish juvenile justice system.
