Abstract

The European judiciary has made significant steps towards the decriminalisation of migration in Europe. Judicial developments have rendered revisiting European immigration law and policy in order to take full account of fundamental rights as enshrined in the Charter and the ECHR and the rule of law a matter of urgency.
