Abstract

On 14 September 2006, the Commission published its third report on the Product Liability Directive (PLD).1 In astonishing contrast to the previous report,2 the Commission announced “that the Directive works by and large in a satisfactory way and that there is no need for amendments at present”3. This suggests that all problems observed in 2001 have miraculously been resolved, which is quite suprising, particularly in light of the ECJ rulings rendered ever since which alone seem to speak a different language.
