1. Wer die geplante Rechtsgutsbeeinträchtigung noch nicht vollendet hat, kann freiwillig vom Versuch zurücktreten und wird dann straffrei (§ 16; dazu näher AT I 31.Kap). Diese Möglichkeit gilt für alle Delikte. Sie endet aber, sobald die Tat formell vollendet ist, also alle Tatbestandsmerkmale erfüllt sind.
