Abstract

This report focuses on explaining the federal constitutional system in Argentina and how it interplays with Human Rights conventions and protective systems. For a better understanding I will divide the topic in the following three sub-sections: (i) the relationship among general treaties and the law; (ii) The constitutional hierarchy of Human rights treaties and declarations and (iii) Integration into supranational organizations and the hierarchy of the resulting norms. I will also illustrate some tensions in between these systems by referring to a recent case decided by the Supreme Court. Finally, I will also analyse the impact of constitutional law and rights in the recent reform of the Civil Code as another form of legal pluralism.
