Abstract

This chapter highlights some of the principal challenges of investigating alleged unlawful killing or mistreatment by military personnel. These include obstacles that investigators encounter when investigating during armed conflict or occupation and challenges common to investigations generally such as witness cooperation, staff turnover and the potential impact of rank. We also touch on wider debates about self-regulation, external oversight, media pressure and political interventions.
