Abstract
There have been a number of themes that have recurred throughout this book: the need to identify the incentives of the parties to settle a dispute, the problem of facilitating the participation of all affected parties, the means by which compliance to agreements can be secured, and so forth. The textual material and cross-reference problems that have followed the principal cases have been intended to emphasize the breadth of these themes. There have been several issues, however, that—though implicit in much of the preceding material—deserve separate treatment. These are considered next.
