Abstract

Sexual harassment of tenants by landlords is a serious problem today. Although the extent of the practice is not fully known, it is likely widespread and can produce a profoundly negative effect on its victims. This chapter explores and critiques some of the important legal and ethical issues that have arisen. In particular, the article examines the seminal cases of Shellhammer v. Lewellan and Gnerre v. Massachusetts Commission Against Discrimination. In presenting the current legal environment spawned by these cases, the authors offer proposals for creating a fairer and more ethical environment for both tenants and landlords in dealing with sexual harassment in housing.
