Surrogacy and the Family

Social and Value Considerations

  • Chapter
Beyond Baby M

Part of the book series: Contemporary Issues in Biomedicine, Ethics, and Society ((CIBES))

Abstract

The topic of surrogate parenting arouses strong feelings. The Baby M case and its aftermath stirred powerful emotions in millions made aware of the drama through newspaper, magazine, or television coverage of the trial, or, through the made-for-TV movie. Unexpectedly faced with the need to come up with law and policy on surrogacy, state legislatures may act hastily, without examining how surrogacy and other reproductive arrangements challenge us to articulate shared values about the meaning of family life, parenthood, sexuality, and reproduction.

An earlier version of this article was presented as a “Staff Discussion Draft” to the Task Force on New Reproductive Practices of the New Jersey Commission on Legal and Ethical Problems in the Delivery of Health Care at its meeting of March 16, 1988. The views expressed herein reflect those of the author and not those of the Commission or its Task Force on New Reproductive Practices.
