Study on Circulation of Right to Use Rural Curtilage

Abstract

The ultimate goal of the balanced urban and rural development is to make a new pattern of integrating urban and rural economy and society realized. The limit to the circulation of the right to use rural curtilage is a reflection to the unequal rights that are enjoyed by urban and rural residents, can not adapt to the needs of the balanced development of urban and rural areas, gives rise to serious waste of land resources, goes against the benefits of peasants to make full use of curtilage resources, and also makes a large amount of “invisible markets” with hidden contradictions existed. Therefore, in terms of the right to use rural cartilage, it is necessary to ensure the equal rights of both urban and rural residents based on the ideas of legislation, build up a compensated obtainment and deadline use system and a strongly operational circulation system, and also make an improvement to the rural social security system that is the foundation of circulation.
