Abstract
A practical approach to medico-legal problems in psychiatry depends upon a sound grasp of the theoretical principles involved. We shall therefore deal briefly with the principles of torts, liability and compensation, before examining in detail the special problems involved in evaluating the claims of victims who have suffered psychiatric injury. The growing field of medical negligence claims in relation to psychiatric treatment will not be dealt with here, although many of the principles and practical points outlined in this chapter will also apply to these cases.
