Forensic Analysis of the Engineering Design Process

Abstract

Forensic engineering, or the application of engineering knowledge to legal problems, is a well-established field with highly developed techniques available for gathering of evidence, analysing failures, investigating accidents, reviewing safety issues and presenting conclusions in the form of opinions. A particular area of concern within the general field is the engineering design process itself. When legal claims are made such as: the design didn’t work; the performance did not meet the specifications; the designers made mistakes; the machine destroyed itself; the design was copied or the patent was infringed - then the process by which the design came about is called into question.

Some common issues involved in forensic analyses of the engineering design process are presented, together with illustrative examples. It is concluded that the substantial hidden costs of insurance and product liability built into the price of every product may be reduced by effective use of the symbiotic relationship between engineering design research and forensic engineering.
