Legislation to prevent circumvention of bans on direct tobacco advertising
Although prohibition of tobacco advertising is one of the most effective control strategies, arguments based on national economy have caused most countries to have only partial legislative bans on tobacco promotion. Incomplete restrictions are defective and provide opportunities for evasion. In Malaysia, direct tobacco advertisement in the local media is unlawful, but this does not apply to advertising at points of sale or advertisements in foreign publications circulated in the country. The legislation is also silent on other forms of tobacco promotion, hence giving alternatives to the industry to market their products. The use of tobacco brand names and logos on services and non- tobacco products is one of the best ways of disguising cigarette advertising.
