Abstract
The end of the Cold War has left German foreign policy with the formidable task of meeting the expectations of its partners that Ger-many assume a greater responsibility in the management of interna-tional affairs. This view is almost universally shared within the German strategic community.' There also is a widespread consensus within this community that assuming a greater international respons-ibility requires Germany's willingness to participate in military actions of a collective security type. However, the political debate in Germany for the most part centred on the legal question of whether or not the German constitution allowed the participation of the Bundes-wehr in such international military operations other than for self-defence.2 In its decision of 12 July 1994 the Bundesverfassungsgericht, the German Supreme Court, has rejected the position of those who claimed that the German Constitution did not allow the out-of-area deployment of the German Bundeswehr, i.e. its use for a purpose other than meeting the mutual defence obligations stipulated in the Washing-ton Treaty and the WEU. According to the Bundesverfassungsgericht, article 24, section 2 provides a clear justification for the participation of German armed forces in multilateral peacekeeping as well as in peace-enforcement actions, whether under the auspices of the United Nations or within the framework of NATO or the WEU.3
