Abstract
In 1985 the Strategic Defence Initiative has become the key issue of all military and political discussions, both in Europe and the United States. Though the ABM Treaty played on important role in the public debate, the legal dimension of an intensified militarisation of space attracted no particular attention in the FRG1. Therefore, this paper is focused on the three most important questions of the legal discussion:
The challenged value of the Outer Space Treaty.
The importance and survival of the ABM Treaty.
The need for a new legal instrument to prevent an arms race in space.
