The US Regulatory Framework

The transportation of radioactive materials is regulated by both the US Department of Transportation (DOT) and the US Nuclear Regulatory Commission (NRC). To avoid duplication of effort, these two agencies partition their regulatory responsibilities by means of a Memorandum of Understanding. Although both agencies regulate packaging and shipment of all quantities of all radioactive materials, as a practical matter under the Memorandum of Understanding, the DOT mainly concerns itself with safety conditions of carriage of all quantities, performance standards of Type A packaging for small quantities, and packaging for low specific activity material. The NRC is primarily concerned with reviewing and certifying designs of packagings for all quantities of fissile materials and for significant quantities of other radioactive materials.
