Abstract
Although this chapter concentrates on the property rights of married and cohabiting couples, the same rules (except for some statutory provisions which apply only to spouses) apply to any other family member. Many property disputes are in fact about the family home because of its value not only as a financial asset but also because it provides accommodation for the family. Most of this chapter is therefore concerned with the question of ownership and occupation of the family home.
