Abstract
In this chapter residence and contact arrangements for children on the breakdown of their parents’ relationship are considered, whether their parents are married or unmarried. The law applicable to disputes about children on family breakdown is laid down in the Children Act 1989 (see Chapter 13), although the legal requirements for the supervision of children whose parents divorce are laid down in s.41 Matrimonial Causes Act (MCA) 1973 and the Family Proceedings Rules (FPR) 1991. When the new divorce law comes into force (see Chapter 9), the supervision of children whose parents divorce will be governed by s.11 Family Law Act 1996 instead of s.41 MCA 1973.
