Abstract
Section 7 of the Patents Act 1977 provides that ‘any person can apply for a patent’. This would imply that there are no conditions as to nationality of the applicant or the country where the invention was made, unlike the position in copyright law. Section 7(2) states that patents can be granted to (a) the inventor and joint inventor, (b) other persons entitled to property in the invention or (c) successors in title. Sections 8 and 9 deal with disputes regarding the ownership of patents and s.10 provides guidance on how disputes between joint applicants are to be handled.
