Abstract

An employer must notify the local Department of Employment –Office in advance of any dismissals which are likely to lead to claims –for a redundancy pay rebate (Redundancy Payments Rebates Regulations– 1965 Reg. 3). There appears to be no such obligation in respect– of rebate claims for lay-off or short-time redundancy payments, nor– in cases of constructive dismissal. Reg. 3 only requires advance– notification of a claim for a rebate which may arise in consequence of– the termination by the employer of an employee’s contract of– employment or the expiration of a fixed term contract.–
