Abstract

The legal relationship between an employer and an employee is created by a contract. This contract is usually known as a contract ‘of services’ or ‘of employment’. The basis of the contract is that the employee undertakes to work for the employer and in consideration he is paid for the work by the employer. The Industrial Relations Act,1971, defined a contract of employment as a contract of service or of apprenticeship, whether it is express or implied, and if express whether oral or in writing.
