This paper is a résumé of the problems implicit in the legal treatment of business crime in Spain. It includes a brief historical note which should permit a better understanding of the present state of affairs. Finally, I have tried to pinpoint the causes of a phenomenon which has been unanimously pointed out by Spanish courts: business crime has benefited in Spain — as in many other Western countries — from excessively lenient legal treatment.
