This chapter explores the law relating to post-conviction Confiscation Orders in England and Wales and examines the challenges faced by judges and practitioners in criminal courts when applying civil law concepts of trust, company and family law to calculate a defendant’s benefit from crime, along with the difficulties that arise in making orders that are just, proportionate and realistically enforceable.
