The UK at a Crossroads

This chapter discusses current developments in the UK that have brought investigations of military misconduct to the fore. These include (1) government plans to repeal the Human Rights Act and limit the jurisdiction of the European Court of Human Rights, as well as possible derogation or even withdrawal from the European Convention on Human Rights, (2) accusations that judges are interfering in the military sphere by extending human rights protection to conflict zones, (3) the need for robust UK investigations to prevent International Criminal Court investigations of incidents in Iraq and Afghanistan, and (4) the need for the UK to maintain its reputation as a legitimate exporter of rule of law expertise.
