Zusammenfassung
Das Streikrecht ist in Deutschland nicht ausdrücklich gesetzlich geregelt, sondern aus dem sog. Richterrecht entwickelt. Gewährt wird das Arbeitskampfrecht verfassungsrechtlich als Ausfluss der Koalitionsfreiheit bzw. Tarifautonomie in Art. 9 Abs. 3 GG (sog. Doppelgrundrecht positive/negative Koalitionsfreiheit).
