“Nur im Okzident!” Der bekannte Anfang der Vorbemerkungen zur Religionssoziologie, den Max Weber eindringlich und feierlich in einer Reihe von Abschnitten wiederholt, um die Besonderheit der Formen zu betonen, in denen sich das moderne Rechtswesen und die Rationalität des Westens herausgebildet haben (vgl. Weber 1922: 1–15),1 ist der Schlüssel für das, was dieser Aufsatz vorlegen möchte, nämlich die Rechtskultur als europäische Besonderheit auszuweisen.
