Digitalization as a Method to Enhance the Mechanism of Procedural Protection of Civil and Financial Rights

Abstract

The article deals with the issues of ensuring the protection of rights and legitimate interests of legal entities in the field of civil jurisdiction with regard to the modern trend of civil procedure digitalization. The federal target program “Development of the Judicial System of Russia for 2013–2020” and some amendments to the Civil Procedure Code, the Federal Law “On Enforcement Proceedings” and other acts are intended to ensure the transition to a compulsory electronic enforcement proceeding. Therewith, the scientific community discusses the relevancy and expediency of introducing e-justice in Russia and using artificial intelligence technologies in adjudication. The international practice already uses particular elements of e-justice. In the course of the study, we analyzed the arguments of the discussing parties. In general, the judicial community and practitioners are wary of possible innovations, especially the idea of artificial intelligence technologies. A new finding of the research is the proposal on the algorithmization of writ proceedings as a digital service and the subsequent algorithmization of some elements of the enforcement proceedings.
