Abstract

A trademark is a word, phrase, symbol, or design, or combination of words, phrases, symbols, or designs that identifies and distinguishes the source of the goods or services of one party from those of others. Trademarks promote competition by giving products and device a corporate identity and by extension of potential marketing leverage. Medical device companies in particular use trademarks to establish their brand and to protect their company name, company logo, product names and product lines. When a new medical device product is developed, companies are quick to secure trademark protection because it prevents others from using the mark on a similar product, and also prevents competitors from using any name that is confusingly similar to the protected trademark. Hospitals, healthcare professionals and patients alike grow to trust certain medical device brands over time, and trademarks are just one of the ways to help patients and healthcare providers easily recognize the source of the product.
