Abstract
The aim of this chapter is to consider one of the most basic aspects of self-determination, dignity, and freedom: it deals with the freedom of religion analysed from the perspective of the religious believer’s status. This work will analyse how the legal status of ‘religious believer’ is protected by both EU and international law, and how its exercise has been conditioned by the jurisprudence of the European Court of Human Rights (ECtHR) and the Court of Justice of the European Union (CJEU). Analysis of EU law, international provisions, and CJEU and ECtHR case law demonstrate an articulated landscape that moves from the promotion and defence of religious believers’ fundamental rights, beginning with the right to manifest one’s personal belief or religion and not to be discriminated against on the ground of belonging to a certain religion. In this perspective, European and international institutional actors and judges have played central roles in implementing anti-discrimination legislation, enforcing the right to manifest one’s personal and religious beliefs and to human dignity.
