Abstract
The expropriated, along with the acquiring authority, is one of the two sides of the expropriation relationship, but also the weakest given that he/she will be dispossessed of his/her assets or rights. It is therefore important to grant the expropriated party with the due guarantees in order to soothe the loss of property caused by the public interest.

In the USA it is commonly known as the ‘eminent domain’, which, according to Black’s Law Dictionary is the inherent power of a governmental entity to take privately owned property and convert it to public use, subject to reasonable compensation for the taking.
