Indian practice relating to international law

Introduction

This compilation sets out Indian practice on international law. It includes practice which indicates the Indian position on questions of international law, or demonstrates Indian compliance with or violation of an international law obligation, or illustrates the working of internal municipal processes which control India’s engagement with and involvement in the international law-making process.

This compilation is divided into two sections – one section each covering judicial and executive practice - all covering the period from 1 October 2016 to 31 March 2017. The judicial section covers judicial decisions from the Supreme Court of India, the High Courts and various tribunals. The executive section draws on materials published on the websites of the Permanent Mission of India to the United Nations in New York City1 and Geneva2, the Press Information Bureau,3 the Parliament of India,4 and the Ministries of External Affairs,5 Defence,6 Home Affairs,7 Commerce and Industry,8...
