Zusammenfassung

Charlie Gard starb am 28. Juli 2017 in London nach einem sehr kurzen Leben (11 Monate und 24 Tage) an einem mitochondrialen DNA-Depletionssyndrom (MDDS). Zwischen den behandelnden Ärzten und Charlies Eltern entstand sehr bald ein heftiger Konflikt bezüglich der Behandlung. Dieser wurde an britischen Gerichten, am Europäischen Gerichtshof für Menschenrechte und in der Weltöffentlichkeit ausgetragen. Im Fall Charlie Gard waren mehrere Subjekte involviert: a) primär Verantwortliche; b) sekundär Verantwortliche und c) indirekt Verantwortliche: Journalisten, Persönlichkeiten des öffentlichen Lebens und die zwei Spitäler. Im Beitrag wird die Verantwortlichkeit der einzelnen Subjekte analysiert.

Abstract

Charlie Gard died on 28 July 2017 in London after a very short life (11 months and 24 days) of mitochondrial DNA depletion syndrome (MDDS). The treating doctors and Charlie’s parents soon had a heated conflict over the treatment. This conflict took place in the British courts, at the European Court of Human Rights, and on a global stage. In the Charlie Gard case, several parties were involved: a) those primarily responsible; b) those secondarily responsible; and c) those indirectly responsible: journalists, public figures, and two hospitals. The article analyses the responsibility of each party.
